Human Rights Report Claims U.S. Hostile Towards ILLEGAL Aliens

Which One of these Illegal Aliens Are Being
Discriminated Against by Border Patrol Agents?
Jim Kouri Reports on the Law Enforcement Examiner: While a majority of American citizens, according to polls, believe the Obama Administration is doing too little to secure the U.S.-Mexican border, a human rights group complains that Border Patrol officers discriminate against Latinos and have caused the deaths of illegal aliens in a new "study."

Yesterday, Amnesty International USA released their report, "Hostile Terrain: Human Rights Violations in Immigration Enforcement in the U.S. Southwest," in which the group alleges that U.S. law enforcement officials are guilty of discrimination in their enforcement practices.

"Communities living along the U.S.-Mexico border, particularly Latinos, individuals perceived to be of Latino origin and indigenous communities, are disproportionately affected by a range of immigration-control measures, resulting in a pattern of human rights violations," the study claims.

However, many within the law enforcement community believe Amnesty International's study is flawed since the only people living on the Mexican side of the border are Latino and the vast majority of lawbreakers sneaking across the border are fromindigenous communities.

"If Norway shared the southwest;border with the US, and they were experiencing poverty, hostility and danger in their nation, U.S. citizens, politicians and law enforcement officials would be discussing the problem of Norwegian illegal aliens entering the United States," said NYPD police officer Iris Adriana.

"The left-wing, open-borders crowd continue to put out bogus press releases and statements that are basically anti-police and anti-American," Officer Adriana said in a telephone conversation with the Law Enforcement Examiner.

The U.S. government has actually relaxed security along the nearly 2,000-mile border with Mexico in recent years. The federal government has even prohibited ;state and local police forces from enforcing immigration laws such as in the case of Arizona.

Attorney General Eric Holder and the U.S. Justice Department recently accused the Maricopa County Sheriff's Office in Arizona of engaging in systematic racial profiling against Latinos in its efforts to crack down on illegal immigration, a charge thus far unproven.
>
The Amnesty study said federal immigration programs that operated in conjunction with state and local police put "Latino communities, indigenous communities and communities of color along the border at risk of discriminatory profiling."

A Homeland Security Department spokesman said the report's finding were based "almost entirely on either outdated information or anonymous anecdotes that can be neither investigated nor resolved."

Special Agent Matt Chandler said the Border Patrol, as well as U.S. Immigration and Customs Enforcement "takes allegations of racial profiling and civil rights and civil liberties violations seriously and has processes in place to immediately investigate and take appropriate action as needed."

"The department has worked hard to create a culture where all people are respected and treated fairly and within the bounds of the law," he added.
In addition, as Officer Adriana pointed out, a large percentage of Border Patrol and ICE agents are themselves Latino including the BP Chief, David Aguilar.

The Amnesty International claims:
* Recent immigration policy in certain border areas has pushed undocumented immigrants into using dangerous routes through the US desert; hundreds of people die each year as a result.

* Immigration enforcement in the USA is a federal responsibility. Federal immigration officials are increasingly working in collaboration with state and local law enforcement agencies but improper oversight of state and local law enforcement has led to increased racial profiling.

* Increasingly, state laws and local policies are creating barriers to immigrants accessing their basic human rights, including rights to education and essential health care services. While these laws are targeting non-citizens, these policies are also impacting US citizen children.

* Recent legislation enacted or proposed in several states target immigrant communities and places them, Indigenous communities and other minority communities at risk of discrimination.

* Immigrant communities also face a range of barriers to justice when they are victims of crime such as human trafficking, domestic violence or bias crimes.

However, Amnesty International's "study" neglects to offer evidence to backup the group's allegations, said attorney and political strategist Mike Baker. "As usual, the liberal-left never allows facts to interfere with their allegations and accusations," Baker quipped.

Shall We Be Citizens or Subjects?

NOTE: IF WE ARE SUBJECTS, THEN BORDERS WON"T MATTER
Before the ink was dry, Jefferson
changed "subjects" to "citizens" on the
  Declaration of Independence draft
Pix Via Library of Congress
Ken Blackwell and Bob Morrison, ARRA News Service: In Washington this week, a rare drama is unfolding in the U.S. Supreme Court. The momentous question that is before the court is this: Shall we be Citizens or Subjects?

The high court is considering a historic challenge by twenty-six states to the Affordable Care Act, otherwise known as ObamaCare. Hundreds of people have stood in line, some of them overnight in the chill March air, to get inside. Our colleague, Ken Klukowski, was one of those fortunate few. We are relying on Ken’s reporting and also on the impressions of Virginia Attorney General Ken Cuccinelli.

Ken Klukowski reports what was perhaps the critical exchange in the three-day oral arguments. Justice Anthony Kennedy is widely viewed as the pivotal figure in this case.

His vote is essential to any likely 5-4 ruling. Kennedy mildly said that this health care legislation “changes the relationship of the Federal Government to the individual in a very fundamental way.” With this statement, Klukowski hopefully reports, “the individual mandate—the centerpiece of ObamaCare—is likely doomed.”

We agree, with Ken Klukowski and with Justice Kennedy. It is noteworthy that press reports already capitalize “Federal Government” and lower-case the word individual.

The next question, of course, is exactly how will ObamaCare change the relationship of the Federal Government and the individual?

Thomas Jefferson provided the answer. The National Archives announced with some excitement over the Independence Day weekend in 2010 that they had discovered an early draft of the Declaration of Independence. In it, young Mr. Jefferson scratched through the word Subjects and wrote in the word Citizens.

Archivists instructed us on the importance of the change. They invited us to go through that mental process with Thomas Jefferson as he and we became Citizens of a republic for the first time.

Was this amazing event on the nation’s birthday a portent? The National Archives made this announcement on the first Fourth of July after the passage of ObamaCare. It’s almost as if we were receiving a message from on high. Shall We Be Citizens or Subjects?

Why is this so? America is not like other countries. Ronald Reagan understood why America is exceptional. He offered these words in his Farewell Address to the nation in 1989.

Ours was the first revolution in the history of mankind that truly reversed the course of government, and with three little words: “We the People.” “We the people tell the government what to do; it doesn’t tell us.

But under ObamaCare, government not only tells us, it Mandates. We have seen a great controversy over the first Mandate from HHS . This first HHS Mandate would require religious hospitals, schools, colleges, and institutions provide drugs that can cause abortions, and orders them to further violate their consciences by covering sterilizations and contraceptives.

This is only the first of many Mandates that are coming under ObamaCare. There are literally hundreds of places in this ill-conceived legislation where “the Secretary” determines what is mandated. Life and death decisions for millions will be mandated by an unelected government bureaucrat in a distant city.

Justice Scalia asked Obama administration attorneys: “If the government can do this, what can it not do?” Attorney Mike Carvin represents the National Federation of Independent Businesses, suing the Obama administration. Carvin said: If a person enters the market simply by being born, “that…means they can regulate every human activity from cradle to grave.”

Death and taxes. Benjamin Franklin said those were the only certainties on earth. This truth was reaffirmed in the oral arguments before the Supreme Court, as Ken Cuccinelli reports: Somewhat amusingly, Justice Alito noted that burial costs were expensive and could hit one unexpectedly as well. He further noted that if he was too poor to pay his own costs and hadn’t prepared for his burial, he would still certainly be buried, and those costs would in turn be shifted to others either by raising everyone else’s burial costs if the buriers had to absorb those costs, or we’d all pay higher taxes if the government bore these costs.

Before our liberal readers generously take up a collection for Justice Alito’s burial costs, it is time for all of us to step back and consider very carefully the question that is really before the U.S. Supreme Court this week.

If the Supreme Court upholds ObamaCare, columnist George Will notes, then government’s “power to compel contractual relations would have no logical stopping point.” Which is why, Will says, the case the high court hears this week is “the last exit ramp on the road to unlimited government.” Which will it be: Citizens or Subjects?

Schlafly: H-1B Visas Take American Jobs

ARRA News Service - by Phyllis Schlafly, Eagle Forum: When President Obama was participating in a live video chat, Jennifer Wedel asked him, "Why does the government continue to issue and extend H-1B visas when there are tons of Americans just like my husband with no job?" Her husband is a semiconductor engineer laid off three years ago and still unable to find an engineering job.

We all would like the answer to that question.

The U.S. Census Bureau reports that, counting only U.S.-born individuals, there are 101,000 with an engineering degree who are unemployed, another 244,000 who are not working or not looking for work and therefore not counted in unemployment statistics, and an additional 1.47 million who have an engineering degree but are not working as an engineer.

Obama's answer to Mrs. Wedel sounded like he had been well briefed by the big corporation lobbyists. He even expressed bewilderment that any U.S. high-tech engineer could be out of work because industry executives tell him there is an unfilled "huge demand" for engineers.

Obama said, "H-1Bs should be reserved only for those companies who say they cannot find somebody in that particular field." Yes, indeed, they should. But in fact they are not.

Created in 1990, the H-1B program was designed for employers to import foreign H-1B workers to fill various high-tech jobs only when Americans could not be found, and the law was supposed to make it illegal for an employer to replace an American with an H-1B worker. However, the big corporation lobbyists succeeded in fuzzying up the law so there is now no effective rule to prevent employers from firing American jobholders and replacing them with H-1B aliens.

Big companies prefer H-1B workers because they can pay them significantly less than Americans, never have to give them a raise or promotion, and have the unilateral power to deport them. H-1B workers don't dare to complain about working conditions or unpaid long hours, and can't quit to take a better job.

Most H-1B workers are imported for entry-level jobs and trained by experienced U.S. workers who are then laid off. This process has introduced a new expression and acronym into the English language: DYOG: "Dig Your Own Grave."

One Senator understands this problem: Senator Chuck Grassley (R-IA). In a letter to the President last month, he pointed out how Obama's response to Jennifer Wedel shows he is only regurgitating the corporation lobbyists' sales talk with their phony mantra that "there are better and brighter people abroad."

Grassley said "thousands of qualified Americans remain out of work while companies are incentivized to import foreign workers." Grassley criticized the Obama administration for proposing new rules to "attract and retain highly skilled immigrants" to replace Americans, to expand eligibility for foreign students to remain in the U.S., to eliminate protections for U.S. workers, to allow employers to pay lower wages to alien workers, and to give work authorizations to spouses of H-1B workers, thereby increasing competition for Americans looking for all kinds of jobs.

Obama has made expanding H-1Bs a feature of his reelection campaign, trying to broaden the program that already allows the importation of 65,000 H-1B visa aliens annually. Some people are even pushing the ridiculous notion of stapling a green card to college diplomas, so that foreigners would automatically be allowed to stay and work in our country.

Will that include the 57,000 Chinese undergraduates now in U.S. universities, most of whom were admitted on the basis of fake transcripts and recommendation letters, and are awarded college degrees for which they did not qualify? That's another racket that should be cleaned up.

Dickinson State University in North Dakota awarded degrees to 584 foreign students who did not earn them. On the day of an all-campus student meeting concerning this matter, Education Dean Douglas LaPlante was found dead from an apparently self-inflicted gunshot.

Media coverage of Obama's colloquy with Mrs. Wedel focused on inviting her to send her husband's resume, but the real news should have been jobs. Is Obama ignorant of the unemployment reality facing U.S. engineers, or is he disingenuously reciting the self-serving lies of his high-tech donors?

A good example of how the H-1B visa system works was described in a lawsuit filed against Molina Healthcare Inc., which handles Medicaid and Medicare paperwork for the government, and Cognizant Technology Solutions Corp., which recruits H-1B workers in India. On January 14, 2010, one day after the Department of Labor approved Molina's application for 40 H-1B workers, Molina fired approximately 40 competent U.S. programmers, managers and analysts and hired 40 H-1B replacements imported by Cognizant from India.

That is how H-1B visas work in the real world to take jobs away from Americans.

Illegal alien sentenced to prison for raping 9-year-old girl

One of my favorite video reporters, "MJ" Jacobsen, would have reported the following crime as "100% Preventable." If illegal alien, Alfredo Lopez-Cruz, had been stopped from illegally invading the United States, he would not have raped his then 9 yr old victim. The Attorney General Office, Homeland Security have been failing the American people in the last several administrations.

By Dave Gibson, Immigration Reform Examiner: Hamilton, OH – On Thursday, Butler County Judge Keith Spaeth sentenced Alfredo Lopez-Cruz, 39, to three consecutive prison terms of ten years to life for the brutal rape of a 9-year-old girl in June 2005.

Alfredo Lopez-Cruz

On June 19, 2005, the little girl was riding her pink “Princess” bicycle through the neighborhood when Lope-Cruz called her over to him. He immediately pulled her from the bike and dragged her to his home on Sycamore Street where he raped her, according to court documents.

Afterwards, the girl fled from the scene nude to her family’s home across the street. She told her father of the ordeal who found Lopez-Cruz lying in his bed still naked. However, the illegal alien fled before police arrived.

Two days after the attack, angry neighbors vandalized and set fire to Lopez-Cruz’s home.

Lopez-Cruz stayed on the run until his capture in Mexico in March 2011.\
The case was featured many times on “America’s Most Wanted,” which led to a tip from a viewer in Mexico, eventually resulting in the fugitive’s apprehension.

During the trial, it was revealed that police found the girl’s bike inside Cruz’s home, her clothing still strewn about the bedroom and the victim’s blood on the mattress.

A DNA test showed that Cruz’s saliva was also found on the little girl’s leg and chest. On February 1, 2012, a jury convicted Lopez-Cruz on four counts of rape. Last week, before Judge Spaeth announced his sentence, Lopez-Cruz addressed the court.

Through an interpreter, Lopez-Cruz said: “I never thought of myself getting into trouble. I ask for an opportunity and I’m very sorry for what I did.”

The victim’s father was also allowed to make a statement, staying: “You’ve stolen my daughter’s innocence. She was a little girl when you abducted and raped her. She was a happy little girl. What you did was wrong and you will now have to pay for your actions. My daughter’s nightmare is coming to a close...yours is just beginning.”

Cruz’s attorney, Lawrence Hawkins III, said earlier that he intended to appeal after the sentencing hearing. He claimed that the rape charges were not proven. Cruz’s semen was not found on the girl but his saliva was on her leg and breasts.

Judge Spaeth told Lopez-Cruz: “It’s horrible. A 9-year-old. I cannot imagine what would ever possess you to do this or the terror in this little girl’s mind...for her safety...for the whole situation. I can only imagine the physical pain and emotional pain that she suffered.”

According to her father, the girl, now 15-years-old “is improving every day” and is still in counseling.

Despite the rather overwhelming amount of evidence against his client, Lopez-Cruz’s attorney, Lawrence Hawkins III, told reporters that he plans to appeal after the sentence, claiming that the rape charges were never proven because only Cruz’s saliva was found on the girl.

Amnesty for Illegal Immigrant Women buried in Violence Bill

TEA Party: Amnesty for Illegal Immigrant Women buried in Violence Bill - posted via ALIPAC
NY TIMES: WASHINGTON — With emotions still raw from the fight over President Obama’s contraception mandate, Senate Democrats are beginning a push to renew the Violence Against Women Act, the once broadly bipartisan 1994 legislation that now faces fierce opposition from conservatives. [. . . ]

The legislation would continue existing grant programs to local law enforcement and battered women shelters, but would expand efforts to reach Indian tribes and rural areas. It would increase the availability of free legal assistance to victims of domestic violence, extend the definition of violence against women to include stalking, and provide training for civil and criminal court personnel to deal with families with a history of violence. It would also allow more battered illegal immigrants to claim temporary visas, and would include same-sex couples in programs for domestic violence.

Republicans say the measure, under the cloak of battered women, unnecessarily expands immigration avenues by creating new definitions for immigrant victims to claim battery. More important, they say, it fails to put in safeguards to ensure that domestic violence grants are being well spent. It also dilutes the focus on domestic violence by expanding protections to new groups, like same-sex couples, they say.

Georgia Moves to Halt Enrollment of ILLEGALS in Public Colleges

Times Free Press Opinion reports:
[A] bill in Georgia that would stop illegal aliens from gaining spots in public colleges in the Peach State offered some eye-opening facts about various states' policies on illegal immigrants enrolling in taxpayer-supported colleges and universities.

What's perhaps most remarkable, and troubling, is that so far only two states -- Alabama and South Carolina -- bar illegal aliens from enrolling. Georgia would make three if its bill passes.

That means 47 other states . . . let people who are in the United States illegally take up spots in colleges and universities -- almost certainly denying some seats to law-abiding U.S. citizens. It gets even worse than that, though.

In 12 states, illegal aliens can officially receive in-state tuition rates to attend public colleges and universities if they happen to reside in those states. That benefit -- which can easily come to many thousands of dollars per year -- is denied to U.S. citizens or legal immigrants who happen to live in a different state from the one where the college they want to attend is located.

The states that offer this improper and unjust benefit are California, Connecticut, Illinois, Kansas, Maryland, Nebraska, New Mexico, New York, Oklahoma, Texas, Utah and Washington.

Only four states -- Arizona, Colorado, Georgia and Indiana -- specifically forbid illegal aliens to receive in-state tuition rates.

Perhaps worst of all, three states actually grant financial aid for unlawful immigrants to attend college. Those states are California, New Mexico and Texas.

Supporters of letting illegal aliens attend U.S. colleges and universities say it would destroy their academic dreams to deny them enrollment. And of course there is sympathy for anyone who wants to improve himself through education. But when it comes to sometimes-scarce spots in college classrooms and limited funding for education, there is simply no justification for putting illegal aliens ahead of U.S. citizens and immigrants who have come to the United States through legal processes.

There should be no real controversy over Georgia's legislative attempt to reserve college and university spots for citizens and legal immigrants. Or if there is any debate, it should be over the fact that . . . other states have not yet moved to restrict enrollment in public institutions of higher learning to Americans and lawful immigrants.

It is often said that the federal government cannot find and deport every illegal alien. That is true. But if we cut off the availability of jobs as well as benefits such as higher education, many illegal aliens will deport themselves.

Congress seeks accurate count of ‘got-aways’

Washington Times is reporting:
Rep. Darrell E. Issa has set a deadline of Thursday for Homeland Security Secretary Janet Napolitano. Intent on investigating allegations that the federal agency released “false and misleading border-crossing data,” the California Republican and chairman of the House Oversight and Government Reform Committee has asked her for 2011 operational records from eight border-patrol stations in the Tucson, Ariz., region.

“The numbers appear to dramatically understate the volume of individuals who crossed the border illegally and are neither arrested nor turned back south (‘got-aways’),” Mr. Issa writes in a letter to Ms. Napolitano, . . . that 268,000 people entered the U.S. illegally and were never counted.

“The potential magnitude of the underreporting of got-aways casts doubt on the border-security numbers touted by the department during this administration. If got-aways are in fact being underreported to that extent, then the data on which you based the conclusion that ‘the border is safer than it has been in decades’ is seriously flawed,” . . . Appeals Court: Illegals in Alabama Can Not Be Blocked From Getting Driver’s Licenses

What! A person can break the law by entering the U.S. illegally and then not being a legal resident in Alabama, the legal residents of Alabama are expected to allow the illegal person to obtain an Alabama driver's license! To do what? Commit more crimes, consume more taxpayer's services, potentially have a wreck and kill a legal citizen, potentially a child, and / or destroy a legal person's personal property. And while the illegal is getting their driver's license, maybe then should be allowed the opportunity to register to vote then to later vote illegally. Vote for who - Barack Obama? And this is just the tip of the iceberg on the problems. What about car insurance; who is going to pay for, etc. etc. etc.

Alabama has the sovereign right to establish the requirements for a driver license in their state. And why are the Feds using the term Hispanic? What about illegal Irish, German, Filipino, or even a French Canadian? The Alabama law applies equally. They only want legal residents fof their state getting an Alabama driver's licenses. For the rest of us, we don't want any illegals entering the U.S.A. "What in the H --- " are President Obama and AG Eric Holder doing? The allow unsecured borders, and Holder is responsible for his staff participate in gun running schemes to Mexico. Why are they involved again in a state issue? What are their motives and or agendas?

When leaders of the United States pay more deference to illegals invading the United States than to the 10th Amendment issues or to preserving and protecting the borders of the Unites States, what would you call the situation? Ahem ... way things are these days, it reminds me of a 60's book titled "None Dare Call it Treason."

An appeals court ordered the state of Alabama on Thursday to stop enforcing additional parts of its controversial new immigration law, pending review of a federal challenge to the measure that is considered the toughest in the nation. The U.S. Court of Appeals for the 11th Circuit, based in Atlanta, issued a brief order expanding its initial injunction to include provisions that barred illegal immigrants from obtaining a driver's license and barred courts from enforcing contracts that involved illegal immigrants. The appeals court in October blocked the state from enforcing another key provision of the law that required schools to check the immigration status of children on enrollment. The provisions are blocked pending the outcome of the legal challenge by President Barack Obama's administration, which has argued that regulation of immigration should be handled by the federal government and not the states . . . . Californians Say Undocumented Should be Able to Keep Their Job

According to Fox News Latino: Seventy percent of Californians feel that undocumented immigrants who have lived and worked in the country for at least two years should have the opportunity to keep their jobs, a new poll by the Public Policy Institute of California shows.

Support for that view is highest among Latinos, 92 percent, followed by Asians, 65 percent, and non-Hispanic whites, 60 percent, according to the latest PPIC Statewide Survey.

The poll was conducted via telephone interviews of 2,001 California adults during the period Feb. 21-28.

The survey found that 85 percent of Latinos and 60 percent of Asians see immigrants as a benefit for the state, while 49 percent of whites characterized them as a burden. . . . Read More

Boo-Hoo; Mexican Drug Cartel Boss Doesn’t Like the Way His Arrest Went Down

From One Old Vet - Former Gulf Cartel plaza boss says feds conducted illegal raid

Jared Taylor:
A former Gulf Cartel plaza boss facing indictment in Houston claims federal authorities illegally searched his home looking for one of the organization’s bosses.

The Drug Enforcement Administration arrested Eudoxio Ramos Garcia after raiding his home near Roma on Oct. 27, 2011.

Court records filed in U.S. District Court in Houston say the U.S. Marshals, DEA and other agencies arrived at the two-story home at 600 River Point about noon that day.

The Marshals apparently had learned Gulf Cartel kingpin Juan Mejia Reyes, known as “R-1,” was at the house, armed with high-powered rifles, handguns and hand grenades.

Ramos, the former Gulf Cartel plaza boss of Miguel Alemán, accuses more than a dozen federal agents of entering his house without his permission, a warrant or any probable cause.

Immigration group blasts Boehner for failing to crack down on illegal workers

Roy Beck
By Stephen Dinan, The Washington Times Fed up with Republican congressional leaders, a group advocating a crackdown on immigration will begin running ads Thursday demanding that House Speaker John A. Boehner allow a vote on legislation requiring businesses to use E-Verify, the government database to check workers’ legal status.

NumbersUSA, the group sponsoring the ads, accused Mr. Boehner and his fellow Republican House leaders of blocking the bill over fears that it will anger Hispanic voters in an election year. But NumbersUSA says enacting the bill — which cleared a key committee in September but has since stalled — would help clear out unauthorized workers and open those jobs for Americans.

“Our gloves are off,” said Roy Beck, executive director of the group, who noted that his organization has pushed for action behind the scenes without success. He said the group is now ready to take the issue public with radio and television ads designed to force the GOP to choose between politics and American workers. “At some point, you just have to bring this stuff out into public. We’ve given the leadership all kinds of time, all kinds of excuses, but it’s been six months,” Mr. Beck said.

Immigration is one of the thorniest political issues as the general election in November approaches. Immigrant rights groups have blasted President Obama for failing to move a legalization bill, but NumbersUSA’s decision shows there is just as much frustration on the other side with Republicans, who won control of the House in 2010 while promising to get tough on illegal immigration, but who have not pushed through any major crackdown.

Arizona Gov. Jan Brewer Slammed The Feds

AZ Gov. Jan Brewer
By Machenzie Weinger, Politico: Arizona Gov. Jan Brewer on Tuesday slammed the federal government for its failure to secure the nation’s border, according to a report.

At a border-security expo in Phoenix, the Republican governor said the government’s “abdication of responsibility is the overarching outrage” of America’s illegal immigration crisis . . . .

Immigration isn’t about skin color or racism, she said, but about protecting Americans. During a talk for law enforcement officers and those working in the border-security industry, Brewer blasted both parties in Washington for their failure to secure the U.S-Mexico border and keep citizens safe.

“Of course, there are those in Washington who will tell you — from 3,000 miles away, by the way — that our border is more secure than ever,” Brewer said . . . “No amount of distortion can hide the absolute truth. The federal government, Republicans and Democrats alike, have failed every single American — all of us.”

Brewer cited the killing of Border Patrol Agent Brian Terry — who was shot with guns linked to Operation Fast and Furious — as a prime example of the lack of security on the border.

“America’s failure to understand this problem at a national level and to deal with it has haunted borders like mine for decades,” she said.

Vermont Efforts to Keep Cheap Illegal Farm Labor

ICE Checking Migrant Worker
Erin Hale, Vermont: Addison County dairy farmers and migrant labor activists are pushing for Vermont to adopt an identification system for its undocumented agricultural workers under bill S.238 in the Senate Agricultural Committee.

Though the bill makes provisions for residency registration, work authorization and the right to state services for undocumented farm workers, discussion has focused on how to provide workers with state identification cards. Vermont does not require a driver’s license to operate farm equipment, but lack of identification severely restricts the quality of life of many of Vermont’s undocumented dairy workers.

Natalia Fajardo of Migrant Justice, a Vermont migrant worker advocacy group, framed the issue as a human rights question, in her testimony to the Senate Agriculture Committee on Tuesday, because lack of identification restricts the freedom of movement for many undocumented workers. “We have the ability to allow farm works to move around freely, and that’s what’s at stake here.”

There are an estimated 1,200 to 1,500 undocumented dairy workers in Vermont, 90 percent of whom come from Mexico. The workforce is almost entirely male, and 68 percent stay less than 12 months, according to the Vermont Migrant Education Program.

Access to state identification or recognition of residency could allow workers to obtain a driver’s license and interact with police officers without reference to their immigration status. The Mexican consulate issues consular ID cards to its nationals in the United States, but only the Middlebury and state police accept it.

. . . While the nuts and bolts of an ID program are undecided, Immigration and Customs Enforcement (ICE) was the elephant in the room throughout the hearing.

Issuing identification would still not protect dairy workers if apprehended by ICE. If the IDs were issued through the Department of Motor Vehicles, it could also compromise the state’s eligibility for federal highway funds.

Sen. Sara Kittell, D-Franklin, chair of Senate Agriculture, said the purpose of the bill was not to create a shadow immigration program but to improve the quality of life for dairy workers. Both Kittell and Sen. Robert Starr, D-Essex-Orleans, compared the bill to Vermont’s medical marijuana legislation, where the state does not enforce federal laws because of the perceived public good.

. . . Keith Flynn, commissioner of the Department of Public Safety, gave testimony in support of the bill, saying that his department was also less concerned with enforcing immigration laws than being able to identify individuals.

“Regardless of someone’s legal status in Vermont, law enforcement has a real interest in having a meaningful way of identifying who it is we’re interacting with – whether a suspect of a criminal charge, witness of a criminal charge, or witness to a criminal charge. Even when making motor vehicle stop, we need to know who’s operating it,” Flynn said.

Linking immigration status to driver’s licenses and IDs is a relatively new trend in Vermont, said Dan Barrett, a staff attorney at the Vermont ACLU.

“Vermont doesn’t have a long tradition of grafting immigration concerns into who can drive a car. It seems the state functioned perfectly well before then,” said Barrett. “Public safety concerns underlie the need of driver’s license: can you see well enough, take the written test. I’m sure driving in Mexico or Honduras is not any different than driving here.” . . . [Read Full Story]

At Immigration, It's Sex of One, Half a Dozen of the Other

Tony Perkins, FRC Washington Update: Breaking the law has its advantages--like complimentary sex changes, for one. I suppose now that the Obama administration has dispensed with conscience rights and religious freedom, there's no limit to the health care taxpayers can be ordered to provide. Under new rules from the office of Immigration and Customs Enforcement (ICE), that "care" now rewards illegal immigrants with everything from government-sponsored abortions to transgender hormone treatments. The standards, just released from ICE, insist that law-breakers are entitled to better care than most U.S. citizens!

"A pregnant detainee in custody shall have access to pregnancy services... including abortion services," the guidelines explain. In addition to abortion, taxpayers will also have to foot the bill to get these women to the abortion clinic. As if that weren't outrageous enough, ICE actually commits federal dollars to drugs that are designed to help men look and sound like women and visa versa. "Transgender detainees who were already receiving hormone therapy when taken into Immigration and Customs Enforcement custody should have continued access," the rules state. That's quite a parting gift for people who are trespassing into America illegally.

Chris Crane, President of the National ICE Council, reminds The Daily Caller that most of these detainees are convicted criminals. "They came out of jails and prisons where we treated them based on the charges that they were either convicted of or arrested for. The second they come to ICE, we have to treat them with a completely different standard. We throw law enforcement and security protocol... out the window." Now, it's important for people to understand that these benefits are not defined by the ObamaCare legislation. They are, however, part of the unilateral power vested in the government by the President's health care law. In the 2,000-plus pages of the Patient Protection and Affordable Care Act, there are literally 4,156 issues left to the administration's discretion. We have all come to realize that those issues include outrages like contraception mandates and politically correct surgeries that no Congress would have approved. That's why the health care law is so dangerous. It empowers the government to practice politics--instead of empowering others to practice medicine.

Rep. Lamar Smith (R-Texas) is just one House member stunned by the ICE reforms. "The Obama administration's new detention manual is more like a hospitality guide for illegal immigrants. The administration goes beyond common sense to accommodate illegal immigrants and treats them better than citizens in federal custody." An ICE spokesman tried to tamp down the criticism--but ultimately made it worse by telling reporters, "It is important to note that one of the main goals of the agency... is to increase fiscal prudence and efficiencies within the system." How could the posh treatment of illegal aliens possibly help America's bottom line? And, more importantly, how is exacerbating a mental health crisis like cross-dressing beneficial to them or us? In the end, it doesn't matter who you are. This administration won't let you leave the country without taking some liberal indoctrination with you.

Keep Working America, Illegal Aliens Are Depending on You

by Katie Pavlich, News Editor, TownHall: Tax day is nearly a month away and according to a report from the Treasury Department, illegal aliens will be getting billions in tax refunds off the backs of taxpayers, legally through the tax code.
IMPACT ON TAXPAYERS - Many individuals who are not authorized to work in the United States, and thus not eligible to obtain a Social Security Number (SSN) for employment, earn income in the United States.  The Internal Revenue Service (IRS) provides such individuals with an Individual Taxpayer Identification Number (ITIN) to facilitate their filing of tax returns.  Although the law prohibits aliens residing without authorization in the United States from receiving most Federal public benefits, an increasing number of these individuals are filing tax returns claiming the Additional Child Tax Credit (ACTC), a refundable tax credit intended for working families.  The payment of Federal funds through this tax benefit appears to provide an additional incentive for aliens to enter, reside, and work in the United States without authorization, which contradicts Federal law and policy to remove such incentives. . . .
The IRS is alsofailing to notify legal workers when their identity is stolen by an illegal alien for illegal activity:
Also, employees in the Accounts Management Taxpayer Assurance Program are not taking steps to notify taxpayers when it is obvious their SSNs and names have been compromised.
A couple things wrong with this. First: Clearly the IRS knows these workers are illegal and instead of punishing them for illegal activity, they are rewarding them with tax money paid by legal and U.S. citizen workers. Second: This is just another example of why illegal immigration is an economic issue. Illegal immigration costs taxpayers billions each year in tax refunds in addition to costing states billions as they try to keep up with illegal aliens using public services without paying for them. Third: The IRS is looking the other way on identity theft, a crime that turns the lives of legal workers and U.S. citizens upside down overnight. . . . [Full Article]

Georgia Senate votes to ban illegal immigrants from Georgia's public colleges

If Our Borders Were Secure
GA and Other States Would Not Be Invaded
The Atlanta Journal-Constitution - Illegal immigrants would be barred from attending all of Georgia’s 60 public colleges under a bill the Senate passed Monday.

If Senate Bill 458 becomes law, Georgia would join Alabama and South Carolina in barring these students from public colleges. State college and university officials have said the legislation is not necessary because they have already taken steps to ensure that illegal immigrant students are not taking slots away from U.S. citizens and students legally in this country.

Monday's 34-19 vote makes SB 458 the biggest measure concerning illegal immigration to advance in this legislative session. It follows up on House Bill 87, a sweeping piece of legislation that Gov. Nathan Deal signed into law last year and is considered one of the toughest laws passed by a state legislature in recent years targeting illegal immigration. . . .

SB 458 applies to the 35 colleges in the University System of Georgia and the 25 in Technical College System of Georgia. The bill's sponsor, Sen. Barry Loudermilk, R-Cassville, said it guarantees that taxpayer-supported colleges only serve citizens and those who are in the country lawfully. He and other supporters said it's wrong for illegal immigrants to take slots at these schools since they can't legally work in the country after graduation. . . .

Senate Democrats, in a minority report, wrote that denying illegal immigrant students the chance to further their education "will limit their ability to contribute to Georgia's economy" and "cost Georgia money in the long run." But Loudermilk said illegal immigrant students won't contribute to the state's economy because they can't legally work in the country. "Their option," he said, "is to take the education they receive and go overseas." To stop that, he said illegal immigrants "should not receive a publicly funded, taxpayer benefit." . . . Stupid Immigration Quote of the Week EVER

Hat Tip: This Old Vet

Stupid Immigration Quote of the Week – Cook County Board President Toni Preckwinkle

BY STEVE YOUNG
The good news in yesterday’s Chicago Tribune is that Immigration and Customs Enforcement (ICE) Director John Morton is negotiating with Cook County in an effort to get the county to honor federal immigration detention requests.
In late September 2011, Cook County (a ‘Sanctuary County’ for illegal aliens since 2006) suspended its cooperation with ICE and passed an ordinance that ‘ordered’ the sheriff’s office to ignore ICE detainers for illegal aliens who had committed a crime and to allow the release of criminal aliens once they had posted bail. The Cook County board used the expense of holding suspected illegal immigrants as its excuse to rescind its agreement with ICE.
However, ICE director John Morton in a letter to Cook County Board President Toni Preckwinkle offered to pick up the cost of holding the criminal aliens until ICE agents can show up to remove them. Additionally, Morton said that any detainees would be picked up on the same day the criminal alien posts bail.
While Ms. Preckwinkle has agreed to meet with Morton to discuss this matter, her comment regarding this important policy is enough to leave anyone who seeks to uphold and enforce this country’s laws speechless:

Her statement should be offensive to U.S. citizens and to all legal immigrants who sometimes wait up to ten years going through the proper channels to become legal citizens of this country. Additionally, these criminal aliens will not be treated differently under the law for the charges against them in Cook County. Moreover, Cook County routinely honors detainers from other law enforcement departments that seek detainers on people in their custody.
And yes, people who cross our borders illegally should be deported for breaking our immigration laws.

Overwhelming Majority of Americans Favor Keeping Illegal Aliens Out of U.S. Jobs

NumbersUSA: A nationwide poll conducted by Pulse Opinion Research found that practically all groups of Americans favor mandating the E-Verify system, a free tool that will reduce the presence of illegal aliens in U.S. jobs. The poll, conducted on February 16, 2012, found that 78% of likely voters favor the use of mandatory worker verification, which will open up more job openings for unemployed Americans and legal residents.

It's easy to understand why E-Verify has widespread support, especially with 20 million Americans struggling to find a full-time job. E-Verify is the smart and sensible approach to immigration enforcement that Americans have demanded. Among likely voters who expressed an opinion:
  • 94% of Republicans support E-Verify
  • 84% of Independents support E-Verify
  • 81% of Democrats support E-Verify
Despite these findings, most members of Congress have failed to support E-Verify. Send this critical message to your 2 U.S. Senators and U.S. Representative today, urging them to do more to protect vulnerable U.S. citizens and legal residents from illegal aliens. This is a completely free service. There is no cost to you.

Dear (Your 3 Members of Congress Will Appear Here),
I wanted to let you know about the results of a new poll on mandatory workplace verification: more than three-quarters of all American voters support it! Isn't this enough reason to support mandatory E-Verify legislation and make sure it makes its way through Congress?
Mandating workplace verification is simply an issue of fairness. Right now, unemployed Americans and legal immigrants don't even have first refusal to U.S. jobs. How is this fair? Shouldn't Americans get first crack at jobs in their own country? Mandating E-Verify will make that happen.
Among likely voters who have an opinion, 94% of Republicans, 84% of independents, and 81% of Democrats support making E-Verify mandatory. This is not a partisan issue and nobody in Congress should be using it as such. The 20 million Americans who cannot find a full-time job do not deserve it.
Please support E-Verify and help these Americans get back to work.
Sincerely,
(Your Name Will Appear Here)
