Feds Clear Arpaio of Criminal Charges

Reuters reporter Tim Gaynor must be squirming like a kid who hasn't peed in 7 hours to be writing this article:

Government ends criminal probe of controversial Arizona sheriff

"(Reuters) - The federal government has closed a criminal probe of alleged financial misconduct by Arizona lawman Joe Arpaio, who styles himself as "America's toughest sheriff," saying no charges would be filed, the U.S. Attorney's Office said on Friday. The announcement on Friday marked the end of an investigation that began in November 2010 at the behest of the Maricopa County Board of Supervisors to examine alleged financial improprieties by the county sheriff and his deputies."
You can almost hear the sigh of disappointment. But wait! Gaynor continues:
"A separate federal investigation relating to allegations of civil rights abuses by Arpaio's office is continuing."
Whew! Uh oh, but there's more dropped investigations:
  • A federal criminal inquiry was concluded last summer with the U.S. Attorney's Office in Arizona declining to initiate criminal charges.
  • Also on Friday: federal prosecutors decline to bring charges in connection with allegations that the sheriff's office had misused county credit cards or misspent money from jail facilities.
  • Assistant U.S. Attorney Ann Birmingham Scheel said in a statement that her office "is closing its investigation into allegations of criminal conduct by current and former members of the Maricopa County Sheriff's Office and the Maricopa County Attorney's Office."
"Arpaio, 80, who is seeking re-election to a sixth term as sheriff in November, has been under a separate federal inquiry since 2008 over allegations that he and his deputies engaged in an extensive pattern of civil rights abuses."
How long does a federal inquiry take??? Since 2008? When Obama took office? Isn't this harassment?

Border War Continues: Harry Reid Gives Tax Credits To Illegal Aliens Under Amnesty

By Velcro, Conservative Observer AZ.  I hope you all read Bill Smith's post (see below, story also at IOwnTheWorld), about the 10 ICE agents who filed suit against Department of Homeland inSecurity Secretary Janet Napolitano, rightfully claiming that they are being ordered to break the law they have sworn to uphold (and this isn't the first time - does Fast and Furious ring a bell?).

On the heels of this comes horrible news that I saw first on the Border Patrol union's local 2544 web site, citing a story by FoxNews.com.


Not only has Obama invited millions of illegal aliens to come take American jobs (I know they estimate 800,000, but they don't consider the incentive it creates for more to cross the border and make the claim they're "Dreamers"), they apparently can actually get even more money in tax credits.

"[Senator] Sessions [R-Ala] co-sponsored a bill earlier this year to bar illegal immigrants from receiving the credit, but the bill was blocked from reaching the floor by Senate Majority Leader Harry Reid."

Where is the responsibility? Where is the accountability? It seems the Democrats have decided upon a scorched earth policy as their time in office winds down to November. This current administration has done more to undermine American sovereignty than the Soviets did in all of the Cold War.

ICE Agents File Lawsuit Against DHS Secretary Janet Napolitano

Numbers USA: On August 23, 2012, a group of 10 ICE agents and officers, led by ICE Council president Chris Crane, filed suit against DHS Secretary Janet Napolitano and ICE Director John Morton seeking an injunction against the Napolitano Directive of June 15, 2012. FOX News broke the story shortly after 12 p.m. on Thursday. The lawsuit has been filed in the District Court for the Northern District of Texas, which is in the 5th Circuit. Kris Kobach is representing the agents and officers, and NumbersUSA is financing the effort.
The complaint asserts, and NumbersUSA agrees, that the DREAM Directive:
  • Orders federal law enforcement officers, including the ICE plaintiffs, to violate duly-enacted immigration law, along with the oath of office they swore to uphold the laws and Constitution of the United States, under the guise of “prosecutorial discretion;”
  • Is an unconstitutional exercise of legislative power by the Executive branch;
  • Is an unconstitutional breach of the Executive branch’s duty to ensure that the laws are faithfully executed;
  • Violates the Administrative Procedure Act, which requires DHS to implement new policies through the standard rule-making procedure.
In the complaint, the ICE agents and officers ask the court to vacate the unlawful and unconstitutional DREAM Directive and the unlawful parts of the Morton Prosecutorial Discretion Memo and enjoin Napolitano and Morton (and their subordinates) from implementing the DREAM Directive and from taking any adverse action against agents and officers who refuse to enforce it.

Will Illegals Get Texas ID Cards And Driver’s Licenses?

Good Question for all states! Obama's new deferred deportation of illegals policy has stirred up the illegal alien issue of identification cards in Texas and other states. Below is info from The Texas Tribune article Titled: Lawyers: Approved Deferred Action Applicants Can Get IDs.

At the end of the extracted article, an immigration lawyer said: “Immigration attorneys and civil rights attorneys, we’ll be ready [to sue]. And they can involve the state in expensive litigation. Good times to be had for all.” No wonder our country is being destroyed by lawyers!

by Julián Aguilar, The Texas Tribune: Immigration lawyers and legal scholars say applicants who are approved for deferred action will be able to obtain state-issued ID cards and driver’s licenses under state policies, despite their lack of official legal status in the country.

Gov. Rick Perry on Monday issued a memo to state agencies reminding them that despite the federal policy that allows some illegal immigrants a two-year reprieve from deportation and a renewable work permit, known as Deferred Action for Childhood Arrivals, or DACA, Texas' policies on individuals in the country illegally remain unchanged.

Perry’s office said the governor had no plans to issue an executive order to amend any state policies and did not mention a specific agency he was concerned with. Instead, he used the federal government’s own words to reiterate that applicants — even if approved — hold no status or pathway to citizenship.

“In fact, the [Department of Homeland Security] secretary specifically closed her directive by explaining that [t]his memorandum confers no substantive right, immigration status or pathway to citizenship,” Perry wrote in a letter to Attorney General Greg Abbott dated Aug. 16.

Texas Department of Public Safety rules mandate that applicants for driver’s licenses or IDs or for their renewals prove they are in the country legally.

“An applicant who is not a U.S. citizen, U.S. national, lawful permanent resident, refugee, or asylee must present lawful presence documentation issued by the appropriate federal immigration authority when applying for a non-commercial driver license or identification card,” DPS policy states in its 26-page Temporary Visitor Issuance Guide.

It’s this policy — combined with specific federal definitions of legal status and presence — that immigration lawyers cite as proof that approved deferred action applicants can obtain the state-issued IDs. Even though the form for DACA, the I-821D, is not on the DPS’s current list of acceptable documents, the DPS guidelines indicate that people “granted deferred action status” are allowed a license or ID that must be renewed annually provided they supply the proper documents.

Some people eligible for deferred action began applying last week, and attorneys say it could take weeks or months to receive a response. But attorneys say approved applicants would qualify for a license, even though they may lack status. . . . [Rest of the Article with Links]

States Fight Illegal Immigration

By Kenneth Wallis: DREAM ACTs by both parties had been rejected by US voters so strongly that Obama was unable to pass a DREAM ACT even when he had a supermajority democrat Congress. In a desperate act of hispandering, Obama issued an executive order that blocks ICE from deporting around 1.7 million illegal aliens who then get to file for “deferred action” status. This means some illegal aliens are eligible to receive work papers and driver’s licenses ahead of those still waiting to come here legally.

Just like the fight against Obamacare, state governments are now making a stand. On August 16, 2012 Arizona Gov. Jan Brewer issued her own executive order that says Arizona won’t confer driver’s licenses and other state benefits to Obama’s “deferred action immigrants”. Arizona had already taken a strong stance against illegal immigration with SB1070, Prop 200, and other attrition and enforcement efforts.

Today, Nebraska Governor Dave Heineman issued the same order for his state. With the massive backlash against illegal immigration, more states should follow. A 2010 FAIR study had an estimated 40,000 Illegal aliens in Nebraska. Arizona had an estimated 390,000. The democrat dominated State of Arkansas had an estimated 55,000 in 2010.

Just like Obamacare, Mike Beebe will likely go along with the Obama Agenda. The last page of the Democrat Party of Arkansas Platform states, "We advocate comprehensive immigration reform at the federal level that restores the rule of law and enhances the security for America and which is practical and humane in its approach toward undocumented individuals already in the United States." This path to legal status language shows that the DPA will need to be voted out of power in order for Arkansas to join other states in passing attrition and enforcement legislation.

63% Oppose Driver’s Licenses, Public Benefits for Illegals Who Get Work Permits

Latest Rasmussen Reports gives mixed signals. It appears that American's compassionate but don't like being ripped off. Below are two finding from the Rasmussen Reports that evidence this point:
  • 63% of Likely Voters Oppose Driver’s Licenses, Public Benefits for Illegal Immigrants Who Get Work Permits
  • 73% of Likely U.S. Voters believe someone brought to this country illegally when he or she was under 16 years old who has no criminal record, has graduated from high school or served in the military should be allowed to apply for a legal work permit.

Again: Do American Jobs Need Protection From Illegals?

Bill Smith, Editor: The below note from a reader reminded me of an article posted on Blogs For Borders on Oct. 26, 2011 titled Do American Jobs Need Protection From Illegals?. The article quoted from the "Federal Observer" and included my comments which are still relevant!
"The . . . article deals with the issue of American citizens being out of work and the fact that illegals were taking the jobs. This same scenario has morphed back into existence today. America in the past two decades was been a magnet for people to enter both legally and illegally. However, today there is price to be paid for lax border security. Now we have 20 million illegal aliens living in our country. If we were to remove them from the U.S., it may require an operations similar to those under the administrations of Presidents Hoover, Truman and Eisenhower. Our growing unemployment will explode even further with the return of our military from the numerous combat operations that the US has been involved with."
Almost ten month has passed since the previous article. Are things better? NO! Unemployment is worse! The Economy is worse! Our country is more in debt! The troops have or are now coming home to NO JOBS. The U.S. has even more illegals because of the Obama policies toward illegals and border security. Now, President Obama has opted to usurp our laws and has granted "temporary" amnesty by deferring the deportation of a certain class of illegals in our country. Illegals that are now permitted to openly get in line for American citizen's jobs and for seats in college classrooms. Many may continue to argue that these are young people went to American Schools and are needed workers.

Why are they "needed? workers? We have high unemployment! Do we need these illegals going on to college or taking jobs away from legal American citizens and away from those legally immigrating to our country? Also, should we allow the creation of this fourth class of people in America? Previously we had American citizens, legal immigrants in process of gaining their citizenship, and illegals.

Now we have the Obama's illegal class! These newly "registered" illegals are being given false hope unless, of course, Obama is re-elected. Since these illegals are NOT going through the legal process of becoming a legal resident; they remain without the legal rights of American citizens. Can Obama force States to violate their laws regarding illegals?

This new Obama illegal class must now submit to the desired wishes of the person (Barack Obama) who granting them temporary amnesty in hopes they may gain American citizenship ahead of those who followed the laws and regulations for becoming legal citizens. Having no true allegiance to the Constitution or the rule of law, will they become a force supportive of a potential tyrant?

What did Presidents Hoover, Truman, and Eisenhower have in common?

Back during the great depression, Herbert Hoover ordered the deportation of ALL illegal aliens in order to make jobs available to American citizens that desperately needed work.

Harry Truman deported over two million illegal aliens after WWII to create jobs for returning veterans.

In 1954 Dwight Eisenhower deported 13 million Mexicans. The program was called Operation Wetback. It was done so WWII and Korean veterans would have a better chance at jobs. It took two years, but they deported them!

Wow, if they could deport the illegal aliens back then, they could sure do it today. If you have doubts about the validity of this information, enter Operation Wetback into your favorite search engine and confirm it for yourself.

Why, you might ask, can't they do this today?

Actually the answer is quite simple.....

Hoover , Truman, and Eisenhower were men of honor; not politicians looking for votes!

Arizona Governor: no public benefits for young immigrants

Yahoo News: . . . Arizona Republican Governor Jan Brewer, in yet another clash with the White House, issued an order on Wednesday barring illegal immigrants who qualify for temporary legal status in the United States from receiving any state or local public benefits.

The action was a response to relaxed deportation rules issued by the Obama administration on Wednesday.

Brewer, whose state has been at the center of the country's immigration debate, issued an executive order denying state or local benefits to immigrants applying under the new federal immigration rules. The order would bar them from obtaining an Arizona driver's license or a state-issued identification card.

As many as 1.7 million people could qualify for the temporary federal program, which enables certain illegal immigrants to apply for work permits, Social Security cards and driver's licenses, according to the Pew Hispanic Center.

Applying for "deferred action for child arrivals" permits will shield some young illegal immigrants from being ousted from the United States for at least two years. In Arizona, officials said an estimated 80,000 illegal immigrants were eligible to apply.

To qualify, recipients must have been younger than 16 years old upon arrival; currently not older than 30; have lived in the country since June 15, 2007; and have no felony convictions.

Thousands of eager, young undocumented students swamped immigration offices in states with large immigrant populations like California and Texas on Wednesday.

Brewer wrote in the order that the new program "does not confer upon them any lawful or authorized status and does not entitle them to any additional public benefits."

She said she was reaffirming the intent of current Arizona laws, and preventing "significant and lasting impacts on the Arizona budget, its health care system and additional public benefits that Arizona taxpayers fund."

Arizona passed a tough immigration crackdown in 2010 to try to drive illegal immigrants from the state. In June, the U.S. Supreme Court upheld its most controversial provision requiring police to check the immigration status of people they stop if they suspect they are in the country illegally. Grijalva is a Traitor II: Aztlan and MEChA

In my last post, we saw that Raul "Boycott Arizona" Grijalva (D-Az 3) is still a traitor to his constituency and to America, and would not hesitate to declare economic war on Arizona again.  Of course, the group of people he thought were being marginalized, the ones at the core of the SB 1070 law, are not American citizens, they are illegal aliens.

In the actual quote, he states that his mandate comes by his being elected.  Elected by who?  American citizens, not illegal aliens.  And yet SB 1070 was a "direct attack" on illegal aliens, not American citizens.

"We are elected and sometimes, there is a direct attack, there is a direct issue that affects a group of people that are being marginalized. . . I’m not going to tolerate it. I’m going to speak up every time."

In a nutshell, he sees himself elected, in part, to defend illegal aliens flooding into this country.

[Chasing a rabbit that may have a lot of meat on it, one can ask, "...are there other groups who may be marginalized in Grijalva's district?"  The 28% of Yumans who are unemployed?  The ranchers whose lands are trashed and overrun by illegal aliens?  People who are hoping the Rosemont mine will bring them jobs while Grijalva fights against it because it might hurt the environment?  Conservative journalists Grijalva swears at and rudely walks away from refusing to answer questions?]

I also conclude that Grijalva is a traitor because he supports the "liberation of Aztlan," and the deliberate dissemination of La Raza's propaganda through the establishment of MEChA student organizations

I said a lot in that sentence, and to many of you, this is not news.  But let me break it down.  Aztlan is the name of the region of North (and South) America belonging to the descendants of the ancient people who dwelt there.  Namely, La Raza ("the Race").  [Another rabbit - how can anyone be blind to the inherent racism in this claim?].  La Raza's goal is to exercise economic and political independence, and "self-determination for the people of Aztlan."

MEChA (Movimiento Estudiantil Chicano de Aztlán) is a primary means of accomplishing this, through "education," or more accurately, indoctrination.  Most colleges and universities have MEChA chapters as student "cultural" clubs.  There are also groups of "Brown Berets" (brown shirts?) that represent a military arm of La Raza.

Remember the big hoorah over Mexican-American Studies in the Tucson Unified School District?  This is what that was about .  The State of Arizona decided it didn't want it's young people being brainwashed by MEChA (here's an update).

At this point, rather than boring you further with a post that's too long already, please bear with me and let me present the words of MEChA itself.  I have taken great pains to not take these quotes out of context nor to cut out the flavor of the language; rather, consider this a summary.

This from the National MEChA Philosophy statement:
"Chicanismo does not seek to use the word "Chicano" as an umbrella term when representing all of "La Familia de La Raza". Rather, Chicanismo seeks to educate our barrios and campos about our history y cultura to further create a movement of self-determination for the Liberation of Aztlán, something that Hispanic and Latino has yet to represent or recognize...
"Chicanismo results from a decision based on a political consciousness for our Raza, to dedicate oneself to building a Chicana/Chicano Nation...
"Chicanismo involves a personal decision to reject assimilation and work towards the preservation of our cultural heritage. Recognizing that all people are potential Chicanas and Chicanos, we encourage those interested in developing a total commitment to our movement for self-determination for the people of Aztlán to join Movimiento Estudiantil Chicano de Aztlán (MEChA)...
"Thus, by all means necessary, We Chicana/Chicano estudiantes or Aztlán, dedicate ourselves to taking our educational destiny into our own hands through the process of spreading Chicanismo, in the spirit of carnalismo...
"As Mechistas, we proclaim that we are the people of Aztlán and that we recognize our indigenous unity with our brothers and sisters of Ixachitzlan (Alaska to Tierra del Fuego)...

Arizona Congressman Raul "boycott Arizona" Grijalva Reaffirms Himself as a Traitor

Lest there be any doubt about Arizona Congressman Raul "boycott Arizona" Grijalva's point of view, he reaffirmed it Monday to the Democrats of Greater Tucson.  Consider, as you read the following quote, 1) his readiness to inflict "economic consequences" to his own constituents, and 2) who the "group of people" are that he refers to in the last paragraph.

“My opponents are running on the fact that ‘Oh my God, he said the ‘b’ word and he has caused all this dire consequences to come the state. Let me be unapologetic: we needed to nationalize this SB1070 issue. We couldn’t let it go in to the dark corner and just be a funny, little thing that happened in Arizona. This was a precedent, and the Supreme Court ruled on the precedent that it was unconstitutional in many aspects.”
“We asked the Attorney General to intervene, we asked the administration to intervene. And we said there is going to be economic consequences and there should be. For a state that can be this punitive, there is going to be consequences.”
"Have I taken some hits on that? Absolutely. But the unapology is about this: We are elected and sometimes, there is a direct attack, there is a direct issue that affects a group of people that are being marginalized. . . I’m not going to tolerate it. I’m going to speak up every time. I spoke up then and God willing, it will never happen again.”

1)  Grijalva's pride in having declared economic war against his own constituents makes obvious the fact that his allegiances are NOT with them.  He also makes it very clear that he will do it again if the right circumstances occur.

2)  The "group of people"  that he will not tolerate being marginalized are those at the center of the SB1070 issue:  Illegal Aliens.  Specifically, Latinos Chicanos/Chicanas. 

These two facts quoted straight from his mouth add up to one conclusion.  Raul Grijalva is a traitor to America who supports the influx of illegal aliens ("Chicanos/Chicanas") to liberate "Aztlan".

Rasmussen Reports: Today, Sunday August 12, 2012, most voters continue as they have for years to put border control ahead of legalizing the illegal immigrants already in this country.

A new Rasmussen Reports national telephone survey finds that 56% of Likely U.S. Voters think gaining control of the border is more important than legalizing the status of undocumented workers already living here. Thirty-five percent (35%) put legalizing the status of undocumented workers first. ( Read More).

Tribute to NPS Ranger Kris Eggle on the 10th Anniversary of his Death

By Velcro, Conservative Observer AZ.  Until tonight, I had never heard of Kris Eggle. I will own a lot of that, but its also pretty telling that I had not seen anything over the years in the media about him.

"Ten years ago today, National Park Service Ranger Kris Eggle gave his life for his country. As his family noted on the Kris Eggle memorial website: “In the wake of 9/11, Kris protected his country by intercepting thousands of pounds of illegal drugs, many weapons, and hundreds of illegal lawbreakers from foreign countries, and by guarding a 31-mile stretch of our nation’s southern boundary. Kris Eggle was shot and killed in the line of duty at Organ Pipe Cactus National Monument on August 9, 2002, while pursuing members of a drug cartel hit squad who fled into the United States after committing a string of murders in Mexico. He was 28 years old. As a fellow Organ Pipe ranger commented, ‘Kris died serving his country and his death has great value and meaning. But the life of Kris Eggle, even more than his death, continues to set the standard.’”"

Deferred action program could temporarily legalize 1.8 million young immigrants

President Obama announced his "deferred action" plan on June 15, 2012. Imagine if the military announced they were going to defer taking action to fight specific wars or to respond to certain situations. These deferred illegals will walk among us filled with resentment knowing that anytime if they don't do what Big Brother wants they can be deported. And, Big Brother could even demand that they join in efforts to further destroy the American economy. Mr. Obama is creating a permanent underclass who will eventually wish to vote and the liberals will be right there supporting that agenda. One way to destroy America is to create a second class in America. America was meant to be for its citizens. And citizens were to determine and control their government leaders; not the other way around.

by Liz Goodwin: As many as 1.76 million young illegal immigrants could qualify for temporary legal status under President Obama's deferred action program over the next ten years, says a new report from the Migration Policy Institute. That's more than double the Obama administration's initial estimate of 800,000 people who would benefit from the program.

The new number reflects the Obama administration's updated guidelines released last Friday depicting who qualifies for the temporary legal status, which provides relief from deportation and a work permit. Initially, only young illegal immigrants under 30 who entered the country as children, graduated from high school and had no criminal record would make the cut. Now, young people who didn't graduate or receive their G.E.D. can still apply for the legal status as long as they re-enroll in high school by the time they apply. About 1.26 million people currently meet that description and are aged 15 or older, while another 500,000 people would become eligible in the next 10 years. . . . Full Story

Why the Border Patrol Needs Administratively Uncontrollable Overtime

Border Patrol agents are closing in on a stolen truck racing through the desert between Sells and the Ironwood Forest National Monument in southern Arizona. Shots from automatic weapons ring out from a nearby outcrop and from the top of a ragged butte half a mile away. They are aimed at the Border Patrol agents.

On another day an agent waits 3 hours for the arrival of a van that will carry the remains of 3 people they discovered in the desert back to Tucson for autopsy by the Pima County Medical Examiner. Badly decomposed, it appears that the bodies had their hands bound and were executed.

Needless to say (I hope), events like these do not always fit neatly into a Border Patrol agent's 8 hour shift. They don't break off pursuits of bad guys because it's time to punch a time clock. They are able to continue in an urgent situation and be compensated because of "Administratively Uncontrollable Overtime", or AUO.

Anyone with half a working brain can see why AUO is essential. Which says a few things about the bean counters and certain muckety-mucks in their ivory tower offices in Washington D.C.,  because AUO appears to be a favorite target during budget cuts.

From the Border Patrol's Tucson sector union web site Local 2544.org:
"08-06-12 We have received multiple phone calls from concerned agents today about rumored pay cuts. A supervisor in Naco reportedly addressed the troops at muster today and told them AUO was going to be gone in 90 days. We have received reliable information from sources in D.C. that AUO is on the chopping block. We are working with the NBPC to track down and verify these rumors. In the meantime, we feel it prudent to advise you that if AUO is abolished it will mean a net 20% pay cut for most agents. If AUO and FLSA are abolished it will mean a net 32% pay cut. We realize the importance and seriousness of the information being spread by managers and we will stay on top of it. We have not been able to independently verify the information. But we do know that in addition to what is being put out to agents here, El Paso sector has told checkpoint stations that they will go to 6 shifts to cut AUO. Agents in south Texas are being told that AUO is going away as well. We are working overtime to get additional information. More to follow."

In this economy, and in our dangerous border areas, it makes no sense to cut AUO. Border Patrol agents are not well-paid. They have not been adequately appreciated and cared for by our government. They work under increasingly unbearable conditions imposed by political bigwigs seeking their next cushy appointment by hobnobbing with the elite in Washington's cocktail circuit.

IT'S TIME TO HONOR THOSE WHO DEFEND OUR BORDERS BY AT LEAST NOT CUTTING THEIR PAY!!!

Human immigrants smuggler guilty in Texas wreck

SFGate: A Houston man has pleaded guilty in a South Texas human smuggling case and wreck that left an immigrant dead.

Prosecutors say 22-year-old Leonel Alvaro Abundis-Carreon pleaded guilty Monday in Corpus Christi to conspiracy to transport 14 suspected illegal immigrants. He also pleaded guilty to causing serious bodily injury to a person. . . . Authorities say suspected illegal immigrants were in the cab and the truck bed when the vehicle crashed. One passenger died. Several others were hurt. Abundis-Carreon said he received $125 for each immigrant he smuggled.

Drunk Illegal Alien with FOUR DUIs Kills Baby in New Mexico

The photo to the left is of Aileen Smith holding the lifeless body of her son. Aileen and her husband Zach were traveling along Interstate 25 in San Miguel County, N.M., when a car driven by Ramon Hernandez, 43, collided with their vehicle. Aileen Smith suffered severe contusions to her midsection as well as a broken sternum. She was seven months pregnant with the couple’s first child. She was taken to Christus St. Vincent Regional Medical Center in Santa Fe where doctors performed a C-section in an attempt to save the baby. But the injuries to the unborn child were too severe and he died only minutes after being delivered. The baby died from a massive head injury and blood on the brain, according to a coroner’s report.

Hernandez – an illegal alien from Mexico – has been charged with homicide by vehicle DUI, great bodily harm by vehicle, driving under the influence, reckless driving, driving while license is suspended or revoked, and driving on roadways laned for traffic. According to the New Mexico authorites, Hernandez was convicted of DUI twice in 2000, once in 2003 and once again in 2004. He was also driving on a revoked license at the time of the crash due to multiple unpaid traffic tickets. He has pleaded not guilty. Hernandez is currently being held on a $25,000 cash-only bond as well as an Immigration and Customs Enforcement detainer. New Mexico is one of only two states (Washington) which issues driver’s licenses to illegal aliens. Read the full story here.

100% Preventable: Killings By Non-deported Illegals

The Washington Times reports that the House Judiciary Committee has issued a report that "The Obama administration released illegal immigrants who went on to commit more crimes, including charges of 19 murders, 3 attempted murders and 142 sex crimes."

As we have noted, these crimes and murders were "100% preventable." WT continues, "All told, 16 percent of the nearly 47,000 illegal immigrants the administration was notified of but declined to deport between 2008 and 2011 under its Secure Communities program have gone on to be charged with other crimes, the committee said. . . ."

"But nearly a quarter could have been deported and weren’t, CRS said. They went on to commit the 19 murders, 3 attempted murders and 142 sex crimes, the Judiciary Committee said.

"'The Obama administration could have prevented these senseless crimes by enforcing our immigration laws,' said committee Chairman Lamar Smith, Texas Republican. 'But President Obama continues to further his anti-enforcement agenda while innocent Americans suffer the consequences. His unwillingness to enforce immigration laws puts our communities at risk and costs American lives.'" . . .

Obama's idea of border enforcement



Sen. Sessions hosted a press conference today with top officials from two unions that represent U.S. immigration law enforcement agencies.

ICE agent Chris Crane is President of the National Immigration and Customs Enforcement Council, the union representing America's more than 7,000 ICE agents and personnel. Border Patrol agent George McCubbin, III is President of the National Border Patrol Council, the union representing America's more than 17,000 border agents and personnel.

What Ted Cruz' Victory Could Mean for the Congressional Progressive Caucus

Cruz' victory in Texas is being hailed as a victory for the Tea Party conservatives over business-as-usual mainline GOP candidate David Dewhurst. Heavy hitters came to Cruz' side in the last few weeks including former Alaska Governor and VP candidate Sarah Palin.

Presaging tonight's victory for Cruz was Richard Mourdock's victory over longtime Indiana Senator Richard Lugar. In Nebraska, rancher Deb Fischer beat Jon Bruning, a GOP old hand in that state.

Next: The same national conservative support that helped Cruz, Mourdock, and Fischer must be brought to bear in support of Gabriela Saucedo Mercer (Facebook), in a little-noticed race in southern Arizona. Saucedo Mercer is a living American success story. She immigrated here from Mexico, learned English, learned American history and about the constitution, took and passed the test, then took the oath and became an American citizen the right way.

AZ Congressional District 3 is a district that runs along part of the Mexican border. Immigration is a huge issue here, as is the economy. The city of Yuma, which is no longer part of this district as of this election, has, under the incumbent, a 28% unemployment rate.

Oh, did I mention the incumbent is Raul "boycott Arizona" Grijalva? Grijalva has major national influence. He is the co-chair of the Congressional Progressive Caucus, which most recently pushed hard to get the UN to take on international gun control regulation. Grijalva was one of the contingent of Democrats who walked out of the Contempt of Congress vote on Eric Holder.
But Grijalva's most memorable moment has to be when he urged a national boycott of his own state on national television after the passage of SB 1070. In case you missed it:
